1. Acceptance of Terms
By accessing and using the Biseo platform ("Services"), operated by Biseo Pty Ltd ("Biseo", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Services.
2. Description of Service
Biseo provides a B2B Software-as-a-Service (SaaS) platform designed for beauty and booking businesses in Australia. Features include, but are not limited to, an AI-powered booking assistant, online storefronts, and automated messaging integrations (Kakao Alimtalk and SMS).
3. Account Responsibilities
To use the Services, business partners ("Partners") must register for an account. You are responsible for providing accurate and current information and for maintaining the confidentiality of your login credentials. You agree to accept responsibility for all activities that occur under your account.
4. Subscriptions, Cancellations, and Refunds
Biseo operates on a freemium model. A comprehensive Free plan is available to experience core features. Premium features are available via paid subscriptions.
- Monthly Subscriptions: All paid plans are billed on a monthly basis via our payment processor, Stripe. By subscribing, you authorise us to charge your payment method automatically every month.
- Cancellations: You may cancel your subscription at any time. Cancellations will take effect at the end of your current paid billing cycle. You will retain full access to premium features until that cycle concludes.
- Refund Policy: All subscription payments are strictly non-refundable. We do not provide credits, refunds, or prorated billing for partial months of service. Exceptions to this policy (e.g., in cases of severe billing errors or prolonged platform outages) are made at the sole and absolute discretion of Biseo.
5. Partner Obligations (B2B2C Context)
Biseo acts as a technology provider facilitating interactions between Partners and their end-user customers ("End Users"). Partners are entirely responsible for:
- Obtaining necessary consents from End Users to collect their personal data and to send automated communications (including Kakao Alimtalk and SMS).
- Ensuring that their use of Biseo complies with all applicable privacy and anti-spam laws, including the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth).
6. Service Availability & Modifications
We strive to maintain high service availability, but we do not guarantee that the Services will be uninterrupted or error-free. Platform features heavily rely on third-party integrations (e.g., OpenAI, Kakao Corp, Stripe), and Biseo is not liable for disruptions caused by these external services. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
7. Limitation of Liability
To the maximum extent permitted by law, Biseo Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Services. Our total liability for any claims arising under these Terms shall be limited to the total amount you paid to Biseo in the three (3) months preceding the event giving rise to the claim.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
